In February of this year, 40-year-old Thomas M. Gum was charged with one count each of first- and second-degree criminal sexual conduct. Gum was accused of having sexually molested a 14-year-old Bay City girl over the course of several months, however the alleged victim’s mother described her daughter as a “sociopath,” according to news articles at Mlive.com.
It all began in February when the assistant principal at the school the girl attended contacted Bay City police regarding allegations that Gum had sexually abused the girl. The alleged victim was interviewed in early February by staff at the Nathan Weidner’s Children’s Advocacy Center. She told staff members that the sexual activity began when she was 13 years old, in June of 2012. The girl alleged that Gum had exposed his penis to her on several occasions, and touched her inappropriately. According to court records, the girl’s stepmother didn’t believe her story.
On Thursday November 7, prosecutors in the case requested the charges against Gum be dismissed. Bay County Chief Circuit Judge Kenneth W. Schmidt granted their request, dismissing the charges against Gum, who is now 41 years old. The charges were dismissed without prejudice, and according to court records “for the reason that the interests of justice do not require further prosecution at this time.”
Gum’s trial was to begin on November 13; he alleged in an interview with police that the girl had made allegations against other individuals, and was a pathological liar.
While Gum’s innocence or guilt is not known, the above is a perfect example of how innocent people are accused of sexual crimes they did not commit. News articles state that the girl told her mother that if a request was not granted, she would make accusations against the defendant. People often falsely accuse others of rape or sexual abuse out of anger or spite; this can lead to innocent people spending years or even life behind bars.
