Victorino Bahena Garcia, a 32-year-old illegal immigrant from Mexico, has been arrested on several felony charges after police allege Garcia sexually abused a young girl over the span of several years. Garcia was arrested on August 16th by Clare County Sheriff’s deputies.
On August 17, Garcia was arraigned on the charges in Clare County District Court, which include one count of second-degree criminal sexual conduct and three counts of first-degree CSC. First-degree CSC for those convicted can mean life behind bars. The accused has been incarcerated in the Clare County Jail; bond was set at $500,000.
Those accused of sex-related crimes have rights that must be protected, whether guilty or innocent. In many cases, individuals are wrongly accused of these crimes by those who may have a grudge to bear, or who are trying to get even. While it is yet to be determined how this case will play out, any individual arrested for criminal sexual conduct or any offense which is sexual in nature must consult with a Michigan sex crimes defense attorney at once. Skilled lawyers know the law in Michigan, and how to challenge the evidence against those accused.
Michelle Ambrozaitis, Clare County Prosecutor, stated that the defendant had abused a girl who is now 8 years old and lives in Grant Township from June of 2010 until recently, in August of 2012. During the course of the investigation, deputies discovered that Garcia is an illegal immigrant from Mexico, and that he immigrated several years ago. The U.S. Department of Homeland Security was contacted by deputies. Once Garcia’s case is resolved, the department will seek action concerning his illegal immigration.
Michigan statutory rape defense attorneys know the laws in Michigan regarding sex offenses committed against minors. Even if the individual consented to sexual relations, if he/she is under 16 years old it is illegal, regardless of consent. No criminal intent is necessary in order for someone who engaged in any type of sexual activity, whether or not penetration occurred, to be arrested. The penalties for CSC and/or statutory rape are severe. Consult an aggressive and competent lawyer to protect your legal rights, freedom and future.
