Sanford Man Charged With Sexual Assault of 12-year-old Girl

In November of 2012 David Jeffrey Lapan, a 31-year-old Sanford man, was charged with sexually assaulting a 12-year-old girl over the summer months. Lapan’s case was set for a pretrial conference on February 19 before Circuit Court Judge Jonathan E. Lauderbach.

News reports at Midland Daily News state that Lapan was charged with being a defendant over the age of 17 and two counts of first-degree criminal sexual conduct. In 2010, Lapan was convicted on a charge of attempted felony breaking and entering a building with intent to steal. According to Michigan Department of Corrections records, Lapan was sentenced to probation on the charge and remains on probation until June of 2015.

The Midland County Sheriff’s Office investigated the accusations of sexual assault, which allegedly took place in Mills Township during the time period from July to September of 2012 according to court records. The 12-year-old victim told someone (news reports did not indicate who) that a friend of her family would visit and spend the night on occasion, and that the friend “had sex” with her, according to the sheriff’s office report. The alleged sexual assaults took place in Arenac and Midland counties.

On January 7 Lapan was arraigned before Judge John H. Hart in Midland County District Court; he is currently being held in Bay County Jail on 10% of $100,000 bond. Lapan waived the preliminary exam on February 1.

Michigan sex crime attorneys know that first-degree CSC is one of the most serious sex offenses an individual can be charged with. If convicted, Lapan could potentially face life behind bars. At the very least, he will face a mandatory minimum of 25 years in prison.

Sex offenses are an extremely delicate area; individuals who are innocent are often falsely accused, and children are sometimes “coached” or persuaded to tell stories that may be fabricated. While this is certainly not the case in every situation, it can easily happen, leaving innocent people with ruined lives.

If you have been accused of a sex-related crime or have already been charged, put your freedom and future in the hands of a capable Michigan sex crime lawyer.
